Accepting these terms
Every paid call is offered with a payment challenge naming these terms by version and by hash. Presenting payment against that challenge accepts the version named in it, on behalf of the person or organisation to whom the paying agent's actions are legally attributable. Free calls are made under these terms too.
What these terms cover
These terms govern machine access to the regulatory data interface, which is paid for per call and requires no account. The terms of service published at https://northhammer.com/terms govern platform accounts and subscriptions. Where the two disagree about a call made through this interface, these terms govern that call.
What is sold
A paid call returns the material named by the tool invoked: the text of one published regulatory document, the obligations extracted from one document, or an analytical brief over one document. Every source is published regulatory material. No customer data is offered, and none can be reached through this interface.
What you may do with it
You may store, process, redistribute and build on what is returned to you, including inside a commercial product. You may not present it as an official publication of the regulator that issued the underlying document, and you may not attribute derived analysis to that regulator.
Not legal or regulatory advice
Extracted obligations and analytical briefs are produced with the assistance of automated systems and are informational. They are not legal, regulatory, audit or compliance advice, no professional relationship is created by buying them, and verifying them against the official source before relying on them is your responsibility.
Accuracy and completeness
Documents are ingested from published sources and can lag the source, omit material, or carry extraction errors. Where an answer and the official text disagree, the official text governs. Every document is returned with the citation metadata needed to locate its source.
Price and payment
The price of a call is quoted in the challenge that precedes it, in the asset and on the network named there. That quote governs the call whatever the published price later becomes. A challenge is single-use and expires; a spent or expired challenge is refused and nothing is charged against it.
When you are charged
Payment is settled only after the answer has been produced. A request that matches no record is refused before settlement, so a call that returns nothing is not charged. If settlement fails after the answer has been produced, the answer is withheld.
Presenting a payment again
Presenting a settled payment again for the same request returns the original answer and is not charged a second time. That is how an answer lost in transit is recovered.
Refunds
A settlement on a public blockchain is final and cannot be reversed by us. Where a call is charged and no answer is delivered, write to support@northhammer.com with the transaction reference; the receipt recorded against that call is the basis for putting it right.
Do not send personal data
Requests must not contain information relating to an identified or identifiable natural person. This interface neither accepts requests about individuals nor returns evaluations of them.
Logging and retention
Every request and response crossing this interface is recorded in full, payment material included, and kept for 13 months, after which it is deleted on a schedule. Credentials presented in request headers are redacted by name; request and response bodies are not. Separately from those transport records, the record of a settled call — its amount, the payer address, the transaction reference and the answer that was sold — is a financial record and is kept for as long as tax and accounting law requires. Do not put anything in a request that you would not have retained.
Acceptable use
You may not use this interface to attempt to reach data it does not offer, to probe or circumvent its access controls or its payment mechanism, or to place load that degrades it for other callers. The free tools exist for discovery and may be rate limited.
Availability and changes
No uptime is promised. Tools, prices and accepted payment networks may change or be withdrawn at any time. No such change alters a challenge already issued.
Suspension
Access may be refused where these terms are breached or where a caller threatens the integrity or availability of the service.
Disclaimers and limitation of liability
This interface and everything returned through it are provided as is and as available, without warranties of any kind, express, implied or statutory, including merchantability, fitness for a particular purpose, accuracy and non-infringement. To the maximum extent permitted by law, North Hammer LLC is not liable for indirect, incidental, special, consequential or punitive damages, nor for lost profits, lost data or regulatory penalties. Total aggregate liability for any claim is limited to the amount paid for the calls giving rise to it in the thirty days before it arose.
Changes to these terms
A change to these terms is published as a new version with a new hash. The version named in the challenge you paid against governs that call; a later version never applies backwards to a call already made.
Governing law
These terms are governed by the law of the State of Wyoming, United States, without regard to its conflict-of-law rules.
